Judge Overturns California Ban On Assault Weapons
On Friday, a Federal Judge overturned California’s ban on assault weapons saying it violated the Second Amendment’s right to bear arms.
California prohibited the sale of assault weapons in 1989.
The judge, Roger Benitez, said that “Under no level of heightened scrutiny can the law survive.”
Judge Benitez also granted a 30-day stay of the ruling at the request of Attorney General Rob Bonta. The stay will give Mr. Bonta the opportunity to appeal the ruling, which he has affirmed he will do.
Californian Governor Gavin Newsom and Attorney General Bonta both publicly condemned the decision.
