Supreme Court Seems To Signal Obamacare Will Not Be Overturned
On Tuesday, after hearing initial oral arguments, Chief Justice John Roberts and Justice Brett Kavanaugh suggested that it wasn't the Supreme Court's role to invalidate the entire Affordable Care Act, even if a few of the provisions are deemed unconstitutional.
Legal experts are considering this a signal from the Supreme Court that they do not intend to overturn Obamacare with this latest GOP challenge.
The Republican Party is arguing to eliminate the Affordable Care Act (Obamacare) claiming that the law's mandate to have health insurance is now unconstitutional because the penalty for not having health insurance has been reduced to zero. The penalty reduction was passed by a Republican-controlled Congress in 2017.
Many are concerned that if the act is overturned, it would eliminate protections for people with preexisting medical conditions and threaten coverage for over 23 million people who are currently enrolled in the program.
